Is a garden pavilion subject to approval?
Each federal state has its own regulations on the conditions under which a Building permit for a pavilion is needed. Above all, the size of the pavilion is decisive when it comes to whether a building permit is necessary.
While in Bavaria and Brandenburg an indoor pavilion, i.e. within a contiguous village, may have a room volume of up to 75 m³ without being subject to approval, in Rhineland-Palatinate it is only up to 50 m³, in Lower Saxony and Baden-Württemberg up to 40 m³ and in Hamburg, Schleswig-Holstein and North Rhine-Westphalia even only up to 30 m3. You can find the guideline values of your federal state in the state building code. In addition to the size, other factors are often mentioned here, such as the maximum permissible height or the minimum distance to the property line.
In so-called outdoor areas outside of contiguous villages, a building permit is always required for a pavilion.

The necessary distance from garden sheds or pavilions to the neighbouring property depends on the respective state building code. Each federal state has different regulations, whereby a distance of 3 meters must usually be maintained.
In addition, the regulations of the development plan also play a role when it comes to the distance of your wooden pavilion to the property line. If the development plan specifies distances other than the building regulations, then the regulations of the development plan apply.
